YOUR RESPONSIBILITY TOWARD FULFILLING THE FLORIDA HOME EDUCATION LAW STATUTE 232.0201

You must notify the superintendent in your district in writing of your intent to establish and maintain a Home Education Program. Notification must be filed within 30 days of beginning your home education program. Your letter** must include the name of each child 6-16 years of age, birth date of each child named, address, and a parent’s signature. (The superintendent will keep files for students aged 17 up to graduation for proof of homeschooling.)

Maintain a portfolio of records and materials. This is very important! You must include:

Your documented records: “a log of educational activities which is made contemporaneously with the instruction and which designates by title any reading materials used”

Your sample materials: “samples of any writings, worksheets, workbooks, or creative materials used or developed by the student”

Preserve your child’s portfolio for two years.

Upon written request, you must make your portfolio available for inspection by the superintendent or the superintendent’s agent upon a 15 –day written notice.

Submit an annual evaluation for each child to the district school superintendent. This is due one year from the date the letter of intent or last evaluation results were filed**.
Choose one from the following options:

  An evaluation of the student’s portfolio by a Florida certified teacher of your choice.  
     
  Any nationally-normed student achievement test administered by a certified teacher of your choice. (a few of the common ones are: Iowa Tests of Basic Skills (ITBS), the Stanford Achievement Test (SAT), the California Achievement Test (CAT), the Metropolitan Achievement Test (MAT), the Comprehensive Test of Basic Skills (CTBS) and the Tests of Achievement and Proficiency (TAP) Results are sent to the parents.  
     
  A state student assessment test: Florida Comprehensive Achievement Test (FCAT) Please be advised, the test results will be sent to the district school superintendent and will be used as your annual evaluation.  
     
  A psychological evaluation  
     
  Any other method that is mutually agreed upon by the parent and the superintendent.  
     
  [The first two options are the most popular. We recommend having a portfolio evaluation for kindergarten, 1st grade, and 2nd graders.]  
     

Submit a letter of termination upon completion of your home education program, graduation, enrollment in a public or private school, or if moving from the county. **

**Suggestion: Send your letters and evaluation results certified mail, return receipt requested. Keep the returned receipt and a copy of the letters or results in your files.

STUDENTS WHO HAVE BEEN IDENTIFIED AS EXHIBITING A PATTERN OF NON ATTENDANCE (TRUANT) IN A PUBLIC SCHOOL AND ARE BEGINNING A HOME EDUCATION PROGRAM UNDER FL STATUTE 232.17(f)

Portfolio’s will be reviewed every 30 days during the regular school term by a home education review committee, until the committee is satisfied that the home education program is in compliance with the statute 232.0201 The superintendent will refer the parent to a home education review committee composed of the district contact for home education and two experienced home educators (who have homeschooled for at least 3 years) selected by the parent. The first portfolio review must occur within the first 30 calendar days of the establishment of the home education program.

If the parent fails to provide a portfolio to the committee, the superintendent will terminate the home education program and require the parent to enroll the child in an attendance option provided under statute 232.02 (1), (2), (3), or (5), within 3 days. Upon termination of a home education program the parent will not be eligible to reenroll the child in a home education program for 180 calendar days.
